CLASS ACTION LAWSUIT AGAINST LUMBER LIQUIDATORS FILED IN LOS ANGELES COUNTY SUPERIOR COURT ON BEHALF OF MONTEBELLO RESIDENT

LOS ANGELES – A class action lawsuit against Lumber Liquidators, Inc. was filed Thursday in Los Angeles County Superior Court on behalf of a Montebello resident who purchased laminate wood flooring manufactured by Lumber Liquidators. The lawsuit, filed by the law firm of Kasdan LippSmith Weber Turner LLP, states that the plaintiff purchased the potentially harmful Lumber Liquidators flooring in November 2013 and consequently, residents in the home in which the flooring was installed have been living with the potentially defective and dangerous product for more than one year.

The class action lawsuit could, according to California’s Code of Civil Procedure, apply to “All individuals or entities who purchased laminate wood flooring products, manufactured in China and sold by Lumber Liquidators, on or after January 1, 2011 (the ‘Class Period’).”

“The nature of these types of defective products is that the people who purchase them and live with them do not know they are living with something that, over time, could harm their health and worse,” said Ken Kasdan, senior and managing partner of the Kasdan firm. “The number of people who have purchased and lived with this potentially dangerous flooring, either in a home or a place of work, could make this one of the most wide ranging legal actions in recent history.”

The lawsuit points out that the laminate flooring manufactured by Lumber Liquidators is sold in approximately 38 retail outlets in California and that the suspect flooring products are manufactured with “glues and resins with high levels of formaldehyde” which are less expensive and dry faster than those with lower levels of formaldehyde but are potentially harmful to a person’s health. “Defendants use glues and resins with high levels of formaldehyde to obtain a faster and more voluminous production rate of laminate wood flooring at Defendants’ Chinese manufacturing facilities,” the lawsuit states.

According to the lawsuit, formaldehyde is a colorless, flammable, strong-smelling chemical that is known to be a human carcinogen that causes short-term effects such as burning sensations in the eyes, nose, and throat; nausea; skin irritation; watery eyes, and coughing. Exposure to formaldehyde also poses longer term health risks such as cancer and leukemia.

The lawsuit says that, “Despite their knowledge of the laminate wood flooring’s dangerous failure to comply with CARB (California Air Resource Board) standards for formaldehyde emissions,

[Lumber Liquidators] promulgated and implemented false and misleading advertising . . . as part of a business scheme designed to unfairly and unlawfully reap substantial profits at the expense of Plaintiff and the Class during the Class Period.”
